1. Introduction

Welcome to ShieldsDrone.ca ("we", "our", or "us"). By accessing or using our website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services

ShieldsDrone.ca provides professional aerial photography and videography services in Saskatchewan and surrounding areas, including:

  • Real estate aerial photography and video
  • Lakefront and cottage property photography
  • Event coverage (weddings, corporate events, celebrations)
  • Property inspections (roofs, construction progress, renovations)
  • Agricultural surveys and land mapping
  • Commercial photography for businesses

Our services are provided using a Transport Canada compliant DJI Mini 4 Pro drone (sub-250g) in compliance with Transport Canada regulations and Part IX of the Canadian Aviation Regulations.

3. Booking and Payment

  1. Booking Request: By submitting a booking request through our website, you agree to provide accurate and complete information about the property, event date, location, and service requirements.
  2. Confirmation: We will confirm your booking within 24-48 hours. A written confirmation will be sent via email after payment is received.
  3. Payment: Full payment is required at the time of booking. We accept online payments via credit card. Payment details are processed securely through our payment partner.
  4. Deposit: For certain services, a non-refundable deposit may be required to secure your booking date.

4. Cancellations and Rescheduling

  1. Cancellation by Client: Cancellations made more than 14 days before the scheduled date are eligible for a full refund minus any non-refundable deposits.
  2. Cancellations 7-14 days before: 50% refund will be provided.
  3. Cancellations less than 7 days before: No refund will be provided.
  4. Schedule Changes: Minor rescheduling (up to 7 days before the event) may be accommodated depending on availability, subject to a rescheduling fee.
  5. Weather Rescheduling: In case of adverse weather conditions (high winds, fog, heavy rain, etc.), we may need to reschedule. You will be contacted to arrange a new date. No cancellation fees apply for weather-related rescheduling.

5. Drone Operations and Safety

  • All drone flights are conducted in compliance with Transport Canada regulations (CARs Part IX) and within visual line-of-sight.
  • We hold a basic certificate of amateur radio operator (BRCO) required for drone operations in Canada.
  • We operate DJI Mini 4 Pro drones, which are compliant with Transport Canada's small drone requirements.
  • Flights may be affected by weather conditions, air space restrictions, and local regulations. We reserve the right to postpone or cancel flights due to safety concerns.
  • We are not responsible for delays or cancellations due to factors outside our control, including but not limited to: weather, air traffic, airport closures, or regulatory restrictions.

6. Property and Venue Rules

When visiting your property for a shoot, we agree to abide by:

  • Respecting all posted signs and property rules
  • Not trespassing on adjacent properties
  • Obtaining permission before entering private areas
  • Removing all equipment and trash after the shoot
  • Not damaging property or landscaping

Property owners are responsible for ensuring that it is safe and legal to conduct a drone flight from their property. We are not liable for any accidents, injuries, or property damage that occur due to property owner negligence.

7. Deliverables

  1. Delivery Timeframe: Edited photos and videos are typically delivered within 7-14 days of the shoot, depending on the volume of work.
  2. Deliverable Format: Deliverables are provided via a secure online gallery (password-protected) or as a download link. High-resolution files (original quality) and compressed versions are provided.
  3. Usage Rights: The client has the right to use the photos and videos for personal and business purposes. Commercial use (including resale) requires additional licensing and may incur additional fees.
  4. Copyright: All original photographs and videos remain the copyright of ShieldsDrone.ca, except as expressly stated in writing. This includes the copyright to edited versions.
  5. Revisions: Minor color corrections and format adjustments (e.g., JPG vs PNG) are included. Major edits, retouching, or additional editing hours beyond the initial scope will incur additional fees.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy for information about how we collect, use, and protect your personal information.

9. Limitation of Liability

  • To the fullest extent permitted by law, ShieldsDrone.ca shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from our services.
  • In no event shall ShieldsDrone.ca be liable for delays, losses, errors, or failures to deliver due to factors beyond our reasonable control.
  • ShieldsDrone.ca is not liable for any third-party claims arising from drone flights over third-party property or activities.
  • The client agrees to indemnify and hold ShieldsDrone.ca harmless from any claims, damages, losses, or expenses arising from the client's breach of these terms or their property/venue's rules.

10. Indemnification

You agree to indemnify, defend, and hold harmless ShieldsDrone.ca and its operators from any claims, damages, liabilities, and expenses (including attorney fees) arising out of or related to your use of our services, including without limitation any claims relating to property damage, personal injury, or third-party intellectual property claims.

11. Governing Law and Dispute Resolution

  • These terms shall be governed by and construed in accordance with the laws of Saskatchewan, Canada.
  • Any disputes arising under these terms shall be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through litigation in the courts of Saskatchewan, Canada.

12. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting. Your continued use of our services after changes constitutes acceptance of the modified terms.
